What is the name of your state? new york
When we purchased our house this past September, we found out there was a driveway easement for the winery next door. This easement came about before a driveway was built on their property. We have been told that we cannot park in the driveway since it must be available for their use whenever needed. How can we get this removed from our deed? Now that they have their own driveway why must they still have access to ours? The only place we can park our cars is on the front lawn.

easements are a matter of public record so the easement should not be a surprise to you. If it was, then shame on you, your r e agent, and your attorney.

as to how to get it removed?

ask the ask the dominant tenant is they will reliquish the easment. Offering money may help.

If they won't, you can try to sue to have the courts kill the easement but don;t hold your breath on that one. It sounds like they still use the easement so I would guess you are just simply going to have to learn to live with it.
