I recently purchased a farm house in Illinois. The neighbor behind me has a water irrigator that crosses on the back corner of our property. He said that the easement for this irrigator has been in use for the last 15 years. Previous owners didnt care about it and I do and want him to remove it from my property. I seen his deed for his land and it states a easement. My deed doesnt mention it, It has changed owners two times since I purchased it. Shouldnt the title company that did the search catch this and why wasnt it recorded on my deed? What actions should I pursue. Thanks for the advice......
