Dear Homeguru,
Thanks for your advice on my last question on 12-01-01. We have done some research and found that our neighbor was mad that construction vehicles were parking on the road to offload heavy machinery, as they could not get to the upper elevations on the transports because the road was too narrow. Now that they have built this fence 18' wide on the 50' easement, we can no longer pass each other on this road, and transport vehicles cannot deliver machinery. They have in effect cut off any construction progress. Two of the owners said they would pay to have it widened so transports could come up but the owner of the property refuses to budge and wants engineering reports done on the turns so he can decide if it is feasible to have it widened. I want to know if 1)we notify them that they will be held accountable for any accidents that occur on the narrow roadway as agreed by all parcel owners, that they actually would be; and 2) if it is deemed feasible by an engineer to widen the turns for transports, must they allow it?
Otherwise, builders will be forced to remove the fence for ingress.
Since it is a 50' easement, will this be the option to go with?
