my farm property is land-locked, however, there is an easement on the adjoining farm that allows me access. just recently the neighboring farmer (not the owner) began excavating a ditch on my property for drainage of his farm. the ditch is 3 feet deep and 8 feet wide and is where we access the farm acreage. our roadway was also destroyed along with the lock, cable and posts seperating the properties. in the meantime our tenant farmer cannot get to our field. the neighboring farmer insists that he has a right to drain his field on to our property, though i have been told this is not the natural direction of flow for water runoff. at no time was i asked permission. what are my legal rights? |
