Easement Woes


We live in Texas, just north of Houston. We recently purchased 10 acres. It's roughly 450' wide and 1000' deep. We were made aware of a 60' wide easement that is shared 50/50 between our lot and the 80 acres next to it. The easement runs along the 1000' side and we each own 30' of it. We were not represented and unfortunately weren't made aware of what this really meant. We've now been told by the 80 acre neighbor that we cannot put fencing anywhere inside the 60'. This is our problem. The easement is private and is for use as ingress/egress for the property owners only. We purchased this lot assuming we could put our fence on the edge of our property, now we're told we can't. This means we paid for a 30' X 1000' strip that we cannot include in our fenced property and therefore is completely useless to us. Is this true??? Can we not run our fence down the middle of the easement??? If not, do we have any recourse to the seller???

Kos Have you read the exact words of the easement ? Your best bet is to sit down with a local attorney who can go through your documents for the easement and let you know exactly what you can and cannot do on this easement before spending a nickle on any fence or gate . If you dont know of a local atty BY all means use the link up top and FIND A LAWYER many lawyers have very low cost or free consultations .
