Our family home in Montgomery County Maryland has a property line that extends approx. 5 feet into the neighbors driveway. Our house was purchased in 1953. Since then we have allowed the neighbors to use the driveway. We have another driveway on the opposite side of the house. The neighbors house was recently purchased and the new owner was aware of the property line running down almost a third of the driveway. He now wants to lower the driveway grade to make it handcap accessible. We are opposed to this because of the proximity of two very old Oak trees and the possible destruction of the root system. We are not granting him access to this part of our property and he is threating to sue for the use. We will grant him the use but do not want him to lower our portion. What recourse to we have if he excavates without our permission.
