my father has been in a nursing home for about one year and is running out of private funds to pay for nursing home care. one of his monthly income sources is from a land contract for the sale of his private home in 1998. the payments go direct deposit to his family trust checking account. we are being advised he won't qualify for medical assistance because the balance owed on the land contract is over $2,000.00. therefore, a financial institute must be sought to buy the balance of the land contract and those proceeds used to finance his care. why isn't a land contract a binding legal document in this case? we are perfectly willing to apply the monthly income from the land contract towards his nursing home debt. |
