Eminent Domain


What is the name of your state? California
We purchased a condo using a land contract on October 5 2002. We were served papers March 19,03 that state the complaint of eminent domain was filed March 3,03. The have listed us as former owners and the company that sold it to us as owners. Are we the rightful owner? Secondly they say that they made an offer on the property in August and because we purchased it in October we have no right to any relocation package even though we are the owner occupant. Is this true even though they have not provided us with any documents other than the complaint filed March 3,03. Please Help

**A: this is a complex situation. When you bought on land contract, you became the owner in equity but not legal title. The governement was required to notify all parties in interest with respect to the eminent domain claim. I do not know what the procedure and requirements for a relocation package. You need to contact a real estate attorney to negotiate.
