Question

Six and a half years ago I divorced my husband and moved to another state with my son.I didn't take much as I was traveling so far.He didn't think Iwould really go and avoided the subject until the last minute. I had already enrolled my son in his new school,rented a moving van arranged for my brother to accompany us on the journey and purchased return flight tickets for him.All the arrangments had been made,and he was supposed to handle the legal matters.He didn't even try to see a lawyer until the last minute, and when he did,he used his fathers lawyer.His father has big bucks,and they basically had my back against the wall, with all my plans already made,I could do little but agree to anything they wanted.My husband told me to take whatever I wanted, but I didn't want disrupt the lives of my stepchildren anymore than we already were, and I left all but the bare essentials. Time was running out,and they made it clear to me that if I didn't sign everything they put before me they would delay things, to the point that I couldn't leave as scheduled. (School was to begin in two weeks, and my sons records were another state,awaiting our arrival)In the lawyers office I signed away the right to our home, (which was in both of our names)and which was purchased mainly through my good credit, as he had filed for bankruptcy just a year prior to our marriage.Now, 6 years later, I applied for a small loan at our local bank to buy my son his first car and found out through the ensuing credit check that my name is still on the mortgage for the house. My banker informed me that should my ex-husband default on the loan for any reason, I would still be held responsible.He also informed me that if I had not signed any papers at the mortgage co. that the papers I signed at the lawyers office may mean nothing.My question then is do I now,6 years later, have any legal recourse for compensation on the value of the house(which has almost doubled)? It would serve my ex right,as his kids are all grown and gone and the main reason that i didn't fight for it in the first place is that the kids were already losing their mother, and I didn't want them to lose the home they had lived in for so long, too.He has one boy left at home in a 7 bedroom house.Surely he has had thoughts of selling and moving to something smaller and I feel like I must move quickly before I lose out a second.I just cant stand the thought of him profiting so heavily off something that was ours after the way he and his father took advantage of my desperation to escape what was fast becoming a marriage to the devil.Any advice would be appreciated and the sooner the better.I have a gut feeling that something can be done but that time is running out.And I also have never recieved any final divorce papers of any kind although I requested them from him several times a few years ago.Interesting,huh?

Did you have a lawyer for your divorce. If so contact that lawyer and explain what you have found out. If you did not, I would suggest that you find an attorney to help you with this situation. A real estate attorney or a family attorney would be good choices. There could be a lot at stake here. Hopefully you have copies of the documents you did sign. Good luck.
