My husband tried to help his ex-wife by co-signing for the 2 mortgages on her home 2 yrs ago. He also signed a Quitclaim.

Six months ago, she stated she couldn't pay the 2nd mortgage, so we petitioned the coiurt to allow us to deduct any unpaid mortgage from the next month's alimony. This was granted!

NOW, she has decided to stop paying altogether and states she is moving out of the property. She wants to sign a Quitclaim and wants us to refinance the property...she assumes she can abandon the property and we will have to pay the mortgage AND pay her Alimony in full. By the way, her 2 mortgages exceed the monthly Alimony! The property is now worth $100,000 less than the mortgage pay-off.

At this point, perhaps your best option is to allow her to QC the properties back to your husband and sell them. Petition the court to allow the alimony to be continued attached for whatever deficiencies you suffer as a result even if it takes time.

I might have the court set up this solution first though.
