I recently sold my home, which was mine legally after paying my ex a settlement on his part of the home. Before closing, while checking with the title company to make sure things were in order they informed me that a mechanic's and materialmen's lien was filed on my property by my ex. I was shocked and had not gotten notice of any kind. He claims it is for a furniture payment from the divorce settlement that was never payed and no bills were sent to me by my ex. I am willing to pay any debts that I owe, but is a mechanic's lien legal or bogus concerning this issue? My ex has still not shown bills, receipts, nothing to make this claim true. I was able to close on the property with my $$ still in escrow. Do I need to take legal action to show the lien is false? Looking at the statutes of limitations concerning liens, the procedures for filing was not done correctly and a notice was never sent to me by him. Help! Thanks! |
