According to the rules of my subdivision's Homeowner's Association, there is a requirement to paint wood fences that homeowners decide to put in their lots. Four months ago, my neighbor built his fence and now he needs to paint it because of the Homeowner's rules. The problem that I have is that, because he built his fence very close to my shrubs, he (or the people that he hires) will have to come through my property to try to paint the side of the fence that faces my property. But, because I have a long history of problems with this neighbor, I don't want him to come through my property to paint this side of the fence (I am worried that they will destroy my shrubs that cost me a lot of money when I have my home built!). My question is if the Homeowner's Association still has the legal power to force me to allow this neighbor to go through my private property to paint this side of his fence or I can still deny this access to him?
