We recently had our land surveyed and our neighbors have a fence placed directly on the boundary line. The surveyor has placed ribbons and painted the corner post to clearly mark the fence as the line. It is also drawn up in our deed and drawn on the map. My question is this, we have decided to place fence around our boudary and would like to know if it is legal to attach our new fence to this corner post which is now a boundary line post. Also our neighbor is not the freindly kind if you get what I mean.

Also, since this surveying we have found out that part of the road that we have used to travel to the rest of our land is actually on his land. We did not know this until the survey but this road has been here for over 15-20 years. This neighbor has threatned trespassing and suit especially since we are attempting to place a fence. The part that crosses his land is only about 30 ft. The road was built years ago by coal miners and is used by us weekly if not daily to access others parts of our land. Can we do anything to claim this part of the road or will we have to divert the road another way?
