| Filing a quiet Title? California
Recently my wife and I have taken over her grandmothers farm. We are current deed holders of the 40 acres and 1600 sq' home. As far as we had known the property was held free and clear since 1983. We recently tried to re-finance the home to fix it up; however the Title company says that it has not been reconveyed and that there is an outstanding promisory note on title. The property was orignally held by my wifes grandfather (currently deceased) and according to all family information, no debts were held on the property prior to his passing. Unfortunately, there was no "note deed of trust" sent to him from the prior owners of the farm which he took over before it was forclosed. The title company says I need to file a "quiet title" because the previous owners are both dead and none of the beneficiaries are able to be either found or there are none in order for them to sign away the note deed of trust.
What do I need to do in order to file a "quiet title" AND how do I go about clearing this cloud on the record??? All attempts have been made personally and by the title company to clear the issue; and the title company is supporting evidence to the case.
