forclosure


North Carolina
my mortgage company is forclosing on our home . we have exhausted all avenues to gain more time.they say they are re- activacting the first forclosure and will sell our home on the court housre steps on april 2, 2002. effective april1,2002 our mortgage will be assignrd to another mortgage company. can the first mortgage company who is no longer servicing our mortgage as of april 1st forclose or does the new servicing mortgage holder have to start their oun preciding .if in fact they are able to procede with the forclosure can i file a motion to find out the relationship between the two servicing companies. and if the forclosure does in fact take place how long before we have to vacate and is there any way we can prolong the vacate order and if so for how long

Nice try. The foreclosing lender assigns rights to the servicer so you are still on the hook. Timing should be a question posed to the foreclosure Trustee.
