I recently purchased my first home and after we moved in we received copies of documents that we signed that were sent to the State and sent back. I usually would have just filed it away with my own copies, but as I was looking I found a document in the middle with signatures of mine and my husbands but we did not sign them. We've had nothing but trouble with these people ever since! When we approached them on the subject they said they would just take it out and throw it away?! Is this right, can we get out of our house contract or some compensation for this deliberate action taken by the builders?!

My response:

Well? Are you going to keep us in suspense? What was the document, anyway? Was it something, that had you known about it, would not have signed? Is it something that would have changed your bargaining or purchasing decisions? You may have a cause of action in Civil tort or in equity. Also, if you feel that something was wrong, turn the matter over to your local District Attorney's office for criminal prosecution.

Thank you for your response. The document was the actual contract. The specific page with the forged signatures stated something to the fact that if we didn't close on time or were late with payments that the builder would be able to get compensation from us as well as our realtor. Since this incident we have learned that the builder has failed to pay several of their associates, one which was the drywall and paint company that did the homes in our community. The paint company has very promptly put liens on the homes that they completed, including mine. Original work that should have been completed has never been done. Also, on a recent report I read regarding builders that they put out the beginning of the year; rated our builder as one of the worst in the nation?! It just tends to get worse everyday!

My response:

You may not realize this, but you're in serious trouble! Your land is subject to seizure and sale. What have you done to protect yourselves? Get to an attorney to discuss the liens, and also to take action against the builder. Do this right now, because you don't have much time !!

Thank you for your suggestion. I have a friend at work whose wife is a paralegal to a firm in town. I will have her look into it and set up an appointment with them. Is there anything else that I could possibly do on my own to help?! Or am I over my head completley. I don't have a problem going to an attorney, I just want all my bases covered.
