forming a legal HOA

what are the steps to forming a legal HOA? Will you need a majority vote? can you do it without charging dues, just used for CC&R compliance. If dues are required and a few don't comply what then? we have a few very stubborn people here. They have threatened arrest for trespassing when they were approached to do their part.
