Found mold and leak after closing.


What is the name of your state? Florida

I bought a house in February 2004 and was not told by the previous owner (a realtor) that there had been previously repaired leakage damage in one of the rooms. My inspector did not notice it either. After a recent rain storm I nticed one corner of the carpet under the window was wet. I pulled back the carpet to find it soaked through the pad. After checking the drywall I have found it to be saturated and there is mold on the backside of the drywall and insulation. It is also obvious that the drywall in that area has been repaired previously in the same area which tells me that this problem was pre-existing. The prior owner is the original owner of the house so there is no doubt that the previous repairs were done during ther ownership.

Do I have any recourse with respect to the prior owner's lack of disclosure?

**A: yes, you do. How were you "told" about the repair ie. verbally or via a written seller disclosure statement?

I wasn't told about the repair at all. When I started to remove the saturated drywall I found that the area in question had been previously patched. I took digital pictures as I removed it in case I need to prove it later.

How do I proceed with something like this? Do I contact the seller and see what she says?
