Full DisclosureWhat is the name of your state? CA Hope you can help: - Here's the issue: I sold my house, The people who bought were denied insurance to the house - having found out that it had had a claim on it. They asked me about the claim - I explaind what had happend and gave them receipts of what I had repaired. They found insurance through another insurance Co. - Proceded to buy the house - 4 months after closing, they are demanding money for further repairs from me saying I did not disclose fully. What should I do? |

| First of all Thanks for your help!! They (The Buyers) are claiming that they could not see all of the damage and had assumed that I had repaired all of the items. (Note: They were allowed to re-inspect the property once they found out about the claim (I had nothing to hide) - even after the inspection clause and deposit contingency was over.) During the listing here is how the TDS was listed: - The TDS states: - Are you (Seller) aware of any significant defects/malfunctions in any of the following? B. Yes No. If yes, check appropriate space(s) below. - Interior Walls Ceilings Floors Exterior Walls Insulation Roof(s) Windows Doors Foundation, Driveways Sidewalks Walls/Fences Electrical Systems Plumbing/Sewers/Septics Other Structural Components, (Describe:Slab(s) I had checked no to everything - I had fixed what I thought was significant damage, (Through my own elbow grease and help from a couple of friends who are in the business) and I had lived in the house for almost 2.5+ years after the damage / claim and repairs without any calms, issue or regret - As a matter of fact I had complements from everybody as to how good the repairs were. Apparently the new owners got another opinion - and were advised that they need to refurbish totally, "again" due to previous damage. Well - that's how I see it - and of course- I think the new owners are out to get what they can from me!! - Or they have found an attorney who is convinced that he/she can make money from this disagreement (on Consignment - What has one got to loose) In the mean time I am getting Ulcers - worrying about the outcome - it could be a $5,000 to $50,000 question - (One never knows - once it gets into the hands of crooked Lawyers – THERE ARE A FEW (10 – 20% -) OUT THERE By the way is there any way I can sue back for - the ulcers - no sex -etc.? First thing is mediation if I read the sales contract right!! - But even that costs $$$. With trying to put a daughter thru med school - I do not need this.. - Again your help is greatly appreciated!!! - Thanks a million!!!! - HOME GURU!!! |
