getting a deed restriction changed/reversed

i'm in east tn. we're buying a parcel of land adjacent to us...owner told us that deed restrictions on the land when she bought it (3.1 acres) limit new construction to 1 dwelling--currently the land has none. original owner who set the restriction is deceased; current owner doesn't care about the restriction one way or another.

can we get the restriction changed? we want to eventually subdivide land into two parcels and allow one dwelling on each piece. what are our options? thanks!

You need to have an attorney review the title report with the restrictions.
