getting out of a contract for buying an unsafe home


my brother recently bought an older used mobile home. he signed a hand written contract to buy this home "as is". when he went into the home for a period of time one day, he got very ill. he mentioned this to the man he bought it from and the man told him his last renter also got ill in the home due to all of the mold. my brother told him he didn't want to buy the home then as he did not want to get sick and maybe even die. the man agreed to let him out of the contract but will not give his $500.00 deposit back. it does say in the contract that the deposit is non refundable. is there any way my brother can get his deposit back?
