getting out of a mortgage

I was wondering what options I have to get out of a mortgage. When I got a divorce 5 years ago, my lawyer didn't advise me to remove my name from my homes mortgage. However, my name was removed from the title, due to the fact that my ex-husband was going to stay in the home due to a business that he ran out of it. I am now looking to buy a home of my own, and I have been told that it will be very difficult to do this with my name already on a mortgage. I have asked my ex to re-finance, he refuses. Do I have any legal way to make him remove me from the mortgage? Looking back I see the error of my ways - young, nieve, and too nice. Thanks
