Getting tenant out

My roommate and I live in a 3 bedroom apartment in NJ. His name is the only name on the lease. Our 3rd roommate left a voice mail on his phone on Nov. the 12th saying she was giving us her 30 day notice to move out. In the meantime, we found another roommate and even got our old one to agree to be out by the 30th. However, the old one has now changed her mind and is insisting on not only being there past the 12th, but the whole month of December. Meanwhile, our new roommate's stuff is all in the house now crowding it. The new roomie is being a real champ sleeping at friend's houses, and the old roomie doesn't even stay at the apt. She has slept here one night in 3 weeks! It is just her stuff in the room that is preventing us from moving the new one's stuff in. She is doing this to be vindictive and her dad is a lawyer too, so she always uses the word "legal" in her email.

She even changed the lock on her door, without the landlord's consent and I was now informed that this is against NJ fire code.

We want to make sure she is out by the 12th and that we do not break the law. Again, her name is not on the lease, her rent is late for December and the landlord is coming this week to break the lock off the door. He has a storage place on the premises and we would like to move it there if she wants. We are even willing to eat some of the rent, give her security back in full and help her move the stuff.

What can we do?

Here is our written reply to be posted on Monday to her.

This letter is being written to acknowledge your request to vacate the premises of __________ in the month of December in the year 2005. You made this request on November 12th, 2005 and informed both of us that this was your 30 days notice. You then stated that you could be out by the 1st of December to accommodate all old and new tenants involved. We have realized that you have not been able to find another residence yet and we are willing to make some accommodations for you. We are willing to transport your stuff, at no cost to a nearby building owned by _________, the landlord of both buildings. To please all parties involved, your security will be returned in full and you will not be charged any rent for the month of December if you are completely vacated by 11:59pm on December 12th 2005. Additionally, the alteration to the lock on the door must be returned to its original lock by the 12th as no permission from the landlord was granted and per New Jersey fire code regulations. We appreciate your cooperation in this matter and wish you good luck in the future
