Govenment purchase remainder lotWhat is the name of your state (only U.S. law)? California I own a 5 acre parcel in Los Angeles county. The land was created as a remainder lot of a government sale. The original parcel was 45 acres, The NPS bought 40 acres and left 5 acres as a separate parcel which I own. Do you know what this process is called? I have heard that the land is exempt from normal land rules, Is this true. Where can I find an explanation of this process? I have an access problem and hope this takes care of it. | Kirk I would imagine that your county zoning desk will either already have a zoning use ord that the property could be assigned depending on what the current land use is in the area, Of the original 45 acres what is the 40 they retained used for now? Example , if the 40 was to be part of a new roadway adjacent to a commercial /industrial area they might have already assigned the remaining 5 a commercial / industrial use zoning. |

| Thank you for your response. The property is already zoned SF low density. I was looking for the legal definition of the exemptions to a remainder parcel through a governmental sale or conveyance. I have heard that because the government (The National Park Service) purchased the bulk of the property and left the 5 acres I own, It is exempt from the subdivision map act. I was hoping there was something that would give me access to my land through this exemption. I was looking for the written law. I have had no luck in finding it. Many people (The California Coastal Commission included) have heard of this exception to the map act, I just can't find the documentation. Thanks again for your time... |
