Help! Driveway crosses property line!

What is the name of your state? Virginia
We recently purchase a new construction home. Two days ago surveyors were in my front yard performing a survey and placed a "nail" in my driveway denoting the property line. When buying and building the home the developer informed me the line was 15 feet beyond my driveway. I now find out my driveway is not entirely on my property but on land given to the county for road construction. There is a sense of urgency because a new road is being build right next to my driveway. The only reason we purchased the home and acreage was to have space between us and neighbors and roads! Do we have any recourse and who do we have recourse against (builder, developer surveryor), and what type of recourse. Please help!

What does YOUR survey show???
And what does your builder, developer, etc. say when you brought this problem to them in WRITING???

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

driveway problems

I did notify him and he has not formerly responded. He was out the other day, as well as his surveyors, looking at the stake in my driveway and I ran out to talk to him. He apologized and said to give him a few days and he would try to come up with "the best" solution he could. I also notified the title company and have not had any response. I do not know what to do next. Any information you could give me would help - thank you!
