holding title


What is the name of your state? CA

My husband and I want to buy the two units house that currently my mom in laws live in. Her landlord who is dying and decide to sell his house to us. My mother in laws insisted that i would not be on title to the house. She wants to be on title with my husband. Can my husband hold title with her without me even though my husband and i will be paying the downpayment and the mortgage? What is that mean to me? Can my husband hold title by himself? My mother will not have the money to buy this house but her landlord is selling to us at a below market value just because both my mother in laws and my husband took care of him for several years. Will this house consider as community property since i won't be on title? What is the best way to hold title to this house?
Your immediate response to all my questions are deeply appreciated. The landlord's health is not doing well. We try to resolve this issue with my mother in laws asap before the landlord passes away.

Why?

What is her stake in this, is she putting any money into the venture? If not tell hubby to get a backbone.

She is paying monthly rental, property tax and insurance going forward until she retires (perhaps 5 - 10 years) Also, the deal does not exist without her. Is there an intrinsic value associated with that?

Look in my opinion you have a lot bigger problems than how this title is made out so yes see an Atty now to protect yourself as it seems hubby and Mama are going to do so for themselves.

You seem like a frightened child.
