Need help! We have an homeowners association board running wild. Back in 1985 the condo complex was built along with the CC&Rs. In August of 1996, the board wanted to change the CC&Rs to benefit the association not the homeowners. So they sent out copies of the restated CC&Rs and a ballot and asked for a yes vote. They got very few ballots back. They then sent of a ballot in Sept. again not enough votes. Again in January 1997 they sent out more ballots. Still not enough. You would think this would tell them something. So as to our knowledge they never had enough votes to pass the restated cc&r's.Also the orignal cc&r's stated that the CC&R's could not be changed just amended until 2044. It also stated any amendments needed to be signed by the President and Secretary of the association. So in April 1997, the President and V. President signed the new set and had them recorded. But didn't have them linked to the original set. Homeowners buying today are still receiving the original set. What can we do to make the board show us the votes approving their actions. We are at a loss. JCallahan

Ask to see the minutes of the election where the tabulator announced the count. If they refuse, hire an attorney to file a complaint.
