Hi, from the State of Virginia. Thanks for any help you all can offer. We are home owners in a subdivision with a home owners association for the purpose of maintaining the private roads with in our subdivision. A homeowner on a dead end road has installed a gate across the association's road. His stated intention with the gate is to secure his property when he is away for extended periods. He is the only homeowner past this gate, but there is another person who owns undeveloped lots past the gate. The undeveloped lot owner is concerned that if the gate remains, the homeowner who placed the gate and is blocking the right of way will one day become the owner of the right of way permanantly, thereby preventing access to his undeveloped lots. Our question is are the undeveloped lot owners concerns legitimate? Will the right of way revert to the homeowner after a given number of years?
