I live within a deed-restricted area with several active homeowners associations. The language within our restrictions state that certain Board approval may be "arbitrarily withheld". Is this considered legal? Some residents are actively pursued while others are ignored....?

It is legal but was not written based on your understanding.
It was not written to be discriminatory but to give the Board certain powers.
