Homestead


What is the name of your state? Louisiana I'm trying to find out if a person living on property for 60 years and has used the land for mortgage has a right to the land being deeded to her. Is ther such a thing as Homestead rights?

How did she mortgage it without her name on the deed? Have any and all mortgages been paid off completely? Who is/are current owner(s)?

You might look up your state's laws on adverse possession, but qualifications are more than just living there. It is not adverse if she has (or had) permission to live there.

NO WAY! Putting a mortgage on a property does not give you property ownership rights. If she mortgaged a property that does not belong to her and got away with it, she committed mortgage fraud. Contact your local law enforcement.

These are also known as "squatter's rights" or adverse posession. To determine if an adverse posession claim may exist, check the county records to see if her name appears on the tax records associated with the property. If so, you may have to fight to get your land back.

Your post does not clarify your stake in all this. A little more info is required to offer an informed opinion.
