HOPA - can we lose our age restriction qualification

We live in an active adult community that currently meets the age restriction requirements under FHAA.

Our builder recently began to sell houses to families with minor children and justified the sales by saying that the children are the "guests" of the parents/owners and will not reside in the property for more than 90 days per year. The builder states that in all of the known sales, the buyers own another house & this new one would only be used for part of the year.

When asked who will monitor if the children live here more than 90 days, the builder & HOA stated that the neighbors would have to observe the number of days that the children lived in the house & report any abuse to the HOA for follow up.

Can our community lose its age restrictiion status under HOPA? I am concerned that we will end up like Youngtown, AZ and no longer be considered an active adult community. We are currently 65% sold.

Are we also at risk when owners rent out their property to families with minor children?What is the name of your state?
