Question

How can we Cancel a Real Estate Contract


What is the name of your state? Wyoming

We purchased an RV lot last year, and want to sell it. We listed it with the
real estate company owned by the developer. We feel there is a conflict of
interest here because they also have unsold lots and their focus is on those
lots. They have sold 8-10 developer lots and we have yet to have an offer
on ours even though ours is priced lower and is a view lot. How can we break
the conract?

How long before the contract expires?

We've had the contract for 5 weeks. It expires in June 2006

So those 8-10 developer lots they sold instead of yours all sold and closed in the past FIVE weeks?

Yes. This is somewhat of a resort area with a very short window to sell.
Their total focus is on the developer lots; in fact they have now added
10 more lots to their list (they used to be rentals) and are focusing their efforts on those. They have some very good incentives for buyers of these lots (i.e., 10% discount for cash, 2-year free interest, free annual dues the first year, free property taxes the first year). It's almost impossible for us and others trying to resell to compete. We only wish we had known this before we listed with them. That's why we want to terminate the contract.

UPDATE! We wrote a letter to the real estate company emphasizing our
displeasure with their service and pointed out that there was a conflict of
interest involved, as well as unfair practices. We also told them we were
contacting an attorney to determine what recourse we had. At that point,
they tore up the contract!
