| My mother is the landlord of an apartment building in MA and has recently chosen to evict a family of four. The reasons for eviction are: 1. recurrent late payment of rent 2. living in unsafe conditions - causing fire hazard near a space heater and using this area as a bedroom which puts the tenants at high risk of asphixiation. 3. having more than the original agreement of four occupantsin the apartment. She has sent an eviction notice and given the tenants the expected 30 days and they have not moved out. The time of eviction should have been at the beginning of August. What is her next step? Has she taken all the proper steps up until this point? What are the tenant's rights and what are her rights as the landlord? |

What are the tenant's rights and what are her rights as the landlord?<HR></BLOCKQUOTE> You have not mentioned the State the building is located in, if the lease is fixed or m/m (moot point), if the notice to terminate follows the L/T law etc. Notwithstanding, have her hire a real estate attorney to file for eviction. |
