What is the name of your state? What is the name of your state? What is the name of your state? AZ

Long story but must read all to understand. House title in both names his and her's. House loan only in his name. He has been gone for 2 + years and has continued making payment because he knew she wouldn't. Didn't want to ruin credit. Now its time to do something. He is getting married and wants to buy a new home but cannot with her not willing to get out of this one. She is unwilling to sell, or to buy him out of the loan. She believe's she deserves this home since he left her. Never mind the yearly taxes and the monthy rent he pays. He just finished a custody battle. What are his chances in court? Can she use the children to keep the house. He has a lawyer but he is dragging his feet. He just want's her out, or to buy him out of the loan. What are his options and how long should this process take?

**A: he should be asking his lawyer or he should get a new lawyer. Process could take anywhere from 5 months if she cooperates to over 2 years if she does not.

He has asked his lawyer they drag their feet. My Fiance is in the decision process now on weather to keep his lawyer and wait or to do this himself. So what do you think his odds are if he were go into this alone. He has all the documentation and receipts of payment. All she has is a piece of paper saying that her name is on the title.

In March the lawyer served her with a lawsuit for the things left at the house when he left that she was unwilling to return (computer, ring, car that has now been repo'd because she failed to make payment he has in in writing where she said she would pay it.) She failed to respond to this. So instead of filing for default on the 21st day the lawyer drug his feet yet another time. He has now filed for motion to ammend and is adding the home to the original lawsuit. So we are already 5 months into this. I do see it taking 2 years but i was looking for something other than ask his lawyer, something like weater or not he stands a chance doing this with out a lawyer?

Think twice about deleting your thread since we keep track. Users that delete threads may not get any help in the future because of several reasons ie. your thread may benefit others in the same or similar situation or even get a response at a much later date.
