A tenant took ill during the month that his rent was paid. He was hospitalized and the 1st of the month rolled around. Rent is due and he is incapacitated. Landlord wants to remove his belongings (less than 1 week into the new month) so he can re-rent the home of the senior. Landlord has already entered the rental by the window without the tenents knowledge. Does this senior have any rights? Doesn't an eviction notice need to be delivered to the tenant? Since the tenent is on a life-support system and cannot communicate. Who to and how could this notice be served? No relative has been appointed to take care of seniors responsibilities. How much legal time does a relative have to help senior vacate the rental when he (the senior) doesn't even know what's happening? Does relative have to have legal documents to do this? What? When? and how can relative protect seniors property and rights? Help?

L committed unlawful entry when he crawled through the window. Read 735 ICLS 5/9, Foreceable Entry & Detainer. Someone needs to tell L in writing that T has not abandoned the premises & L may not enter or remove any property. Then someone will have to be appointed the T's conservator, & the conservator will choose to either pay the rent or remove T's stuff to storage & break the lease. Talk to a tenant's union about how to protect T's rights.

That is absolutely Illegal......

The landlord will eventually get his rent money, just NOT TODAY!

If he throws anything out CALL THE POLICE ON HIM.
