What is the name of your state (only U.S. law)? Alabama
Innocent homebuyers rights
We bought a house and closing attorney didn't catch lien that was recorded two days before our closing. US Marshals are seizing the house we now live in & make payments on to satisfy this lien against previous owner. Marshals came out when we weren't home and put papers in mailbox and stapled to our fence posts. They also went to closing attorney and discussed this issue and gave him papers with dates stamped on them ( our papers were a little different and not dated). They also met with lady at records dept. at courthouse twice. My question is why will Marshals not return our calls or why didn't we receive papers with important dates on them too? Are we entitled to all this information too? We have title ins. and are fighting this but feel like they are withholding important info from us. As innocent homebuyers- isn't this our right? They are sharing with everyone else but us.

Work with your title insurance company - that's why you paid for it.

Thanks. We are working with title ins. co. However they won't give us a policy even tho we paid for it thru closing attorney because he didn't send them the paperwork for it after closing like he was supposed to. We have our paperwork we paid for it and he signed it as their agent. Title ins. co. has opened the claim but are back & forth with closing attorney about who's gonna pay. It's been an unfortunate series of bad events starting with seller being dishonest, closing attorney mishaps and title ins. co. Not giving us a policy to read....
