Joint Owner Problem

New Jersey

I purchased a property (2 family house) with a partner in New Jersey about 10 years ago. I then returned to my native Ireland. My name is still on the American mortgage. In that time I have received no rent money and limited correspondence from my friend.

Does anyone know how I can check what monies are left outstanding on the mortgage and what the current value of it would be?

Does anyone know what rights I have? Can I force my partner to sell so I get my fair share? Could he have sold or remortgaged the property in my absence?

Any help would be really appreciated.

Contact the lending institution directly. Then Partition your partner forcing him/her to either buy you out or have the court sell the property.

**A: contact your lender and hire an appraiser.

Does anyone know what rights I have?

**A: you have a right to demand a full rental history and accounting.

Can I force my partner to sell so I get my fair share?

**A: partition action.

Could he have sold or remortgaged the property in my absence?

**A: No, since you must sign the deed.

**A: hire an attorney but be prepared for a fight since you have not been paying your share of the mortgage.
