What is the name of your state (only U.S. law)? Florida

I have two questions regarding joint tenancy.

1. Can you enter into a real estate joint tenant agreement if the mortgage is not yet paid?

2. Will a joint tenant agreement create a tax liability for either of the parties involved? What is the name of your state (only U.S. law)?

**A: yes if the lender agrees to the title transfer. Search due on sale clause.
