My wife and I, as joint tenants, are 50 % owners of a home as tenants in common with my stepson and his fiance, who also are 50 % owners as joint tenants. The home is worth $400,000 and is free and clear. If there is a judgment lien recorded against one of us as an individual, say, for $200,000, does the creditor have a potential recovery of the entire $200,000 or only $100,000, since each individual has $100,000 equity? In other words, do any the remaining three have exposure other than the one against whom the judgment is recorded? How does joint tenancy vs. tenants in common enter into this, if at all? Thanks |
