Land Dispute


We purchased 21 acres of heir property in Byhalia, Ms in 1995 and it 1999 had property surveryed again and divided between my brother and myself. My husband and I built a house in 1999 and moved in in 2000. The neighbors in the rear came over after we moved in and stated the fence which was built in 1940's by my grandfather was the property line, surveys show fence 75' inside our property line. The neighbors are claiming Adverse Possession of this 75'. The bardwire fence was used to keep cattle and horses in, it was not on property line and it weaves thru the property. They claimed to have paid taxes, but I have all receipts of taxes being paid and there is no record. The property was not inhabited after 1976 but the grandfathers house still stand. They are threatening to sue, do we have any recourse?

Yes, you have recourse by filing a counterclaim if they sue.
