Closing delayed b/c title co reports property is landlocked (no legal right-of-way). Title co reports sellers were informed of this 4yrs ago when they inherited property. Seller's agent also knew since he sold property before (2X's+) and is a relative of sellers! Neither seller nor agent disclosed that property was landlocked but listed it as private road access.
Do sellers/agent have any liability to us for non-disclosure?
(we have large earnest deposit and are missing out on other opportunities, must re-apply for mortgage, etc).
Seller's agent wants us to sign 45day extension but we have checked and in past 21days they have not even contacted other landowners!
What happens if they do not meet deadline?
What can we do (i.e. $XX per day past date?) to "push" sellers/agent?
Agent appears to be holding things up (maybe cause he knows he was not truthful?).
