landslide - property dispute


California
I own an empty lot on the bottom half of a hillside. The lot above and slightly to the left of my lot has a home on it and has landslide issue (their backyard soil is disappearing). Their soil has slid down onto the empty lots below their home and onto my lot as well. And now that landslide debris has pushed onto the road in front of my lot (and my neighbor's) causing it to appear it is our soil that is running onto the street. The city is now citing us for "public nuisance". I feel it is not my fault. I heard about "Duty of Subjacent Support". Does my situation fall under that category?
Please advise.

**A: I would say don't say a word. Several years from now when the home slides down onto your property, CA real property laws would allow you to claim this home as your own.
