A leaning block wallHawaii My neighbor is attempting to sell his house. Between our properties is a cement block wall approx. 6 ft tall, the whole length of the property line (about 100ft) It is presumably on my property at the base but due to Arika palm trees growing on my side the base has heaved and the wall is leaning off perpendicular about 1 foot in the worse areas. Not even noticeable from my side (due to the screening vegetation) but,it is an apparent problem to potential buyers for my neighbors property. It doesn't threaten any structures, just looks bad. To complicate matters, the previous owner of the neighbor's property added a layer of fascia stone to his side of the wall that may be adding weight to pull it off perpendicular. The question I have is what is my liability if a sale is aborted due to the wall situation. The neighbor and I are both out of state and haven't communicated directly about this. I see it as a "potential" problem but nothing has come to a head. Is it a "joint problem" we invest in together or is my wall leaning over the line solely my responsibility? Thanks for any advice offered |
