| My husband and I own a bodyshop business. We had a five year lease with a fellow and out grew the building with 9 months left on the 5 year lease. We have had 2 people wanting to take over the lease, but he refuses to dissassemble his paint booth or to allow us to dissassemble it so that space could be used for other purposes. Can he legally hold us to the lease after turning down 2 tenants? We are in South Dakota |

| If the new tenants were willing to sign a long lease or pay to reassemble the paint booth after 9 months, he can't reject them. Since he's rejected perfectly good tenants, the most he can sue you for is the cost of ressembling the booth after 9 months. Get an attorney to write him & explaint he facts of law to him & maybe L will see reason. ------------------ This is not legal advice and you are not my client. Double check everything with your own attorney and your state's laws. tmeek@uswest.net |
