Lease Purchase With Verbal Contract, Then Sold To Other Party?I am in Georgia, USA. I had a contract to pay cash on some land, but then myself and the seller agreed to change it to a lease purchase instead. We never had a written contract for the lease purchase, but I paid him (with monthly payments) several hundred thousand dollars over a few years. Shortly after I made one of the payments, he sold the land for full price to another party. Is there any way that I can get the land back? I have paid more than half the amount of the value of the land to somebody that I trusted, but I had no written contract. Please tell me if I have a case to get the land back, or at least get my money back. Thank You. |

| My response: So, somehow you found out that, without a written contract, you screwed yourself. Talk about "foolish." IAAL |

| "I AM ALWAYS LIABLE", I am just wondering if I can get my money back, or get my land back. I didn't ask if it was "foolish", or not. Thanks |

You didn't realize that fact when you wrote your post, but that's EXACTLY what you asked. No, you can't get your money back. All of your money was, according to the landowner, just rent money. There was no contract for the sale of that, or any other, land. The landowner says, "Gunter" is a whacko, he's crazy, he's nuts." Now, prove otherwise. You screwed yourself. IAAL |

| I am not a lawyer, but it sounds to me like Gunter may have some glimmer of hope here. He says: "I paid him (with monthly payments) several hundred thousand dollars over a few years". That sounds like a lot of rent to me, if these payments were clearly more than reasonable rent could that not be used as evidence some kind of contract existed other than just a lease? I am assuming Gunter paid by check or has some evidence he made the payments. Alligatorob |

Alligatorob **A: the payments were not questioned. The writer cannot b given the land back because the land was never his to begin with. The writer had no legal or equitable title to the property. |
