is this legal???What is the name of your state (only U.S. law)? ny i had a three year private mortgage with a balloon payment. i was behind on my payment (about 5 months) but did start making payments over the last couple of months. 2 weeks ago i received a note from the owners that i had 2 weeks to get my things out by 6/30/09. all my stuff is out with the exception of the things in my shed. i went there tonight and a man came out and said as of tomorrow morning he is the official new owner. i was never served anything in person or by mail except for the note in my door. is this legal? the deed was in my name but he said that they changed it back to their name.What is the name of your state (only U.S. law)? |

| WHO was in title while you were paying on the "note"? What recorded interest DID you actually have? Did THEY have clear title, or were THEY paying on an underlying mortgage?

| my boyfriends name was on the deed. (im posting these questions because he isnt computer savvy and id like to get some idea what his rights are before he spends money on a lawer again). the original owners held his mortgage and no they did not have a mortgage on this property. a couple of months ago he got a call from there lawyer asking him to make arrangements for payments so he wouldnt loose it. i did some research yesterday and saw something about a quick claim which if he signed would relinguish all his rights and give them the right to sell. when i asked if he signed anything, he said yes, that the lawyer said it was just something he never signed at the original sale. bingo, im guessing the quick claim is what he signed but even though ive read that once you sign it its hard to reverse, signing it under false pretenses is not legal. |
