When you take a tenant to court and win, but only if you asked for it in the petition, and only if its reciporcal...

That means if the tenant wins YOU pay his legal bills.

But if you win by default, the tenant doesnt show up and vacates the apartment, you get nothing since you cannot get a money judgement if the tenant is not present for trial.

All you get is posession.......then you will have to sue the tenant in small claims court.
