lein holding us up

we were in the process of purchasing some land. when it came time for closing we found there was a lein on the land and we could not close. We took some money out of a 401K to purchase the land and had to take a penality for early withdrawl. We didn't mind this as long as we were getting the land. Now it looks as though we won't get the land because the lein is for more than
what the land was going to cost and the sellers can't or won't do anything about it. Our closing date was Monday and we have nothing...
Do we have any sort of rocourse taht we can take since we are out of approx $3000 in penality fees?:confused:

No, because before taking the funds out of the 401k, you should have verified the title to make sure it was clear by reviewing the title report.
