    Question

    I live in Missouri. My mother had a lein on the property when she purchased some doors in 1999. In Sept. 0f 2000 the property was transfered to my wife and I (my mothers name is nowhere on the deed) I had a title search done and that lein was the only one. So we went ahead with the transfer. We just had some title work done planning some construction on the property and now there is another one from the same company filed March 9, 2001. What legal right do they have if any to do this they had to have title work done their selves and could see she no longer owns the property or any part of it. Do I have any legal right against them. Would appreicate someones help. I know this will probaly take a lawyer to clear up but need to know what direction to go in.

    You need to pay off the door company and file a release of lien. Once a lien is on title, the lien remains unless paid off even if the property changes ownership. The 2nd lien is unenforceable.

    Do you mean it's unenforcable by the door company? Would either their title company or my county recorder be liable? I knew I would have to pay off the first to clear the lein. What is the quickest way to get them to remove it after it is paid and the quickest way to get the second one removed?

    Hire an attorney who will take the check from you then take care of the payment to the door company and have them sign a Release of Lien document then record it.

    This same attorney can have the 2nd lien removed or negotiate payment. I may have misunderstood your post. If the 2nd lien is for payment due and owing in addition to the amount of the first lien, then the 2nd needs to be handled in the same manner as the first.

    Thanks for your help I now know which direction to go.
    After talking with the company on the 14th they do no title
    searches under $6000 when they found out my mother no longer owned the property it sounded like the second would automaicly come off.
