What is the name of your state? Nevada Daughter & husband bought house 6 yrs ago. They notified builder of several problems, including a leaky roof in the living room within a year, also around some windows and a sliding door. They came out twice but the leaky roof never repaired and then they just ignored the kids calls. Now fast foward to 4 months ago and there is a group of people who want a class action suit due to the several construction problems, they need 20 and only have 10 signed up. When this situation occured the builder started taking care of the problems. Due to leaks in the walls, etc, the builder had us move out for 3 weeks while they tore the house apart. Claimed no toxi mold. Then it is found that there is a problem with the main plumbing pipe in the kitchen. Want to jackhammer a 2ft x 16ft section up to repair the problem, the kids have to move out again. Builder claims this is warrenty work and it doesn't have to be specifically mentioned when selling, is this true? If they sell, can they still join the class action law suit ? Do they have any other possible options, is there a lemon law regarding homes ? Thanks.

**A: Total BS (Builder Stupidity). I guess the builder has never read the Nevada Seller disclosure law. Anyway, after all the problems, who in their right mind would believe anything the builder says.

If they sell, can they still join the class action law suit ?

**A: of course, but they would need to assign their rights to the Buyer.

Do they have any other possible options, is there a lemon law regarding homes ? Thanks.

**A: several options are available including the filing of their own lawsuit separate from the class action. Contacting homeowner groups such as www.hadd.com
(there is a Nevada chapter) and www.hobb.gov, Attorney General's office, Contractor's Licensing office etc. There is no state or national lemon law per se but Nevada is one of the first states to enact something close but it only applies to construction defects on new homes.

You say the new law applies to new homes. This was a new home when purchased so does this new law apply ? Thanks.

**A: no because I believe the law went into effect after the purchase of their property.
For specifics double check with the Nevada chapter of www.hadd.com
